Community Operator Terms & Conditions
Last Updated: January 21st, 2026
Applies To: Community Operators of Public Communities on Pickleheart
These Terms are between Strivers United Inc., a Delaware 501-c-6 nonprofit corporation (doing business as “Pickleheart”) (“Pickleheart,” “we,” “us”) and the individual accepting these Terms (“you”).
By clicking “I Agree” (or otherwise accepting these Terms), you enter into a binding agreement with Pickleheart and agree to comply with these Terms. Pickleheart may update these Terms from time to time.
1. What Pickleheart Is
1.1 Nonprofit Membership Collective.
Pickleheart is a nonprofit membership collective that operates a technology platform to support pickleball communities through shared tools, standards, and benefits.
1.2 Platform Role.
Pickleheart provides technology infrastructure and digital tools that enable users to create, discover, and participate in pickleball communities. Pickleheart’s role is limited to providing and operating the platform and related services.
1.3 Digital Tools and Infrastructure.
Pickleheart provides digital tools, including community content tools and other platform features described in these Terms. Pickleheart does not provide physical facilities, and the platform is not itself a club, court operator, or real-world play organizer.
1.4 Roles at a Glance.
You acknowledge and agree that:
(a) Community Operators administer and manage their Community’s presence on the Platform; Community Operators do not own their virtual community; and
(b) Pickleheart operates the platform technology, including platform-level structures and features.
1.5 Definitions Used in These Terms (Sections 1–4).
For purposes of Sections 1–4:
(a) “Platform” means the Pickleheart technology services, websites, and applications.
(b) “Community” means a social group on the Platform that may have one or more Community Operators.
(c) “Public Community” means a Community intended for use in public-facing contexts (as opposed to private or restricted-access facility communities, which may be governed by separate terms in the future).
(d) “Park” means a location-based entry on the Platform (including parks, playgrounds, or other playing locations) used for discovery and informational purposes.
(e) “Community Operator” (or “Operator”) means the individual(s) designated as a community admin to administer a Community’s presence on the Platform.
2. What Pickleheart Is Not
2.1 No Employment, Partnership, or Agency.
You acknowledge and agree that you are not an employee, contractor, agent, partner, joint venturer, or legal representative of Pickleheart. Nothing in these Terms creates an employment relationship, partnership, joint venture, fiduciary relationship, or agency relationship between you and Pickleheart.
2.2 Not a Facility Operator; No Real-World Supervision.
You acknowledge and agree that Pickleheart does not manage, operate, or control parks, courts, playgrounds, private facilities, or real-world play. Pickleheart does not supervise, direct, or control real-world activities or interactions between users.
2.3 No Ownership or Exclusivity Granted.
You acknowledge and agree that participation on the Platform does not grant you ownership of, or exclusive rights to, any Park, facility, location, or Community. Nothing in these Terms grants any right to control, reserve, restrict, or exclusively use any Park or facility.
3. Communities vs. Parks on Pickleheart
3.1 Communities Are Social Spaces on the Platform.
You acknowledge and agree that Communities are social groups on the Platform and exist as digital spaces where users may share information, communicate, and connect.
3.2 Parks Are Location-Based Entries on the Platform.
You acknowledge and agree that Parks are location-based entries on the Platform used for informational, organizational, and discovery purposes.
3.3 Affiliation Does Not Create Control.
You acknowledge and agree that a Community may affiliate with, reference, or be associated with one or more Parks on the Platform; however, such affiliation is a platform association and does not grant the Community or any Community Operator any authority, control, or exclusive rights over the Park or any physical location.
3.4 Platform Control of Park-Level Structure.
You acknowledge and agree that Pickleheart controls how Park-level entries, information, and platform-level discovery structures are organized and presented on the Platform, including for consistency and neutrality.
4. Your Role as a Community Operator
4.1 Community Operator Role.
As a Community Operator, you are responsible for administering your Community’s presence on the Platform, including managing community-facing information and features that Pickleheart makes available to Operators.
4.2 Managing Community Presence.
You may manage your Community’s page and related community-facing content on the Platform (such as descriptions, posts, updates, and resources), subject to the Platform’s standards and enforcement.
4.3 Managing a Community, Not Owning It.
You acknowledge and agree that you may administer and manage your Community’s presence on the Platform, but you do not own the Community. Communities are not transferable property and may not be sold.
4.4 No Authority to Bind Pickleheart.
You acknowledge and agree that you do not have authority to bind Pickleheart or act on Pickleheart’s behalf. You may not represent that you are a spokesperson, representative, or agent of Pickleheart.
4.5 Individual Acceptance Required.
Each Community Operator must individually accept these Terms as a condition of receiving Community Operator privileges. If you invite, designate, or request another user to become a Community Operator for any Community, that user must separately accept the then-current Terms before Community Operator privileges are activated for that user.
4.6 Changes in Community Operators.
Community Operator privileges may be added, removed, or changed only through Platform functionality (if any) or as otherwise approved by Pickleheart. Any new or replacement Community Operator must accept the then-current Terms as a condition of acting as a Community Operator.
5. Pickleheart’s Role as the Platform
5.1 Infrastructure.
You acknowledge and agree that Pickleheart operates and maintains the Platform’s technology infrastructure and may provide Community Operators with tools to administer and manage their Community’s presence on the Platform.
5.2 Discovery Tools.
You acknowledge and agree that Pickleheart may provide Platform-level tools that help users discover Parks and potential play opportunities (including informational indicators and discovery features displayed on the Platform).
5.3 Suggestions Only.
You acknowledge and agree that any discovery signals, recommendations, or suggested connections provided through the Platform are optional and user-directed. Pickleheart does not guarantee that any user will connect, play, or participate based on Platform suggestions.
5.4 No Supervision.
You acknowledge and agree that Pickleheart does not supervise, direct, or control real-world activity. The Platform provides informational and communication tools only.
6. Content Tools (Core Feature)
6.1 Content Purpose.
You acknowledge and agree that content tools are a core feature of Communities on the Platform and are used to describe Communities and share information with users.
6.2 Community Content.
You may create, upload, and manage content about your Community on the Platform (including descriptions, posts, updates, and resources) (“Community Content”), subject to these Terms and Platform enforcement.
6.3 Park Content.
You acknowledge and agree that Pickleheart controls and administers Park-level entries and Park-related information displayed on the Platform (“Park Content”), including the organization and presentation of Park entries for consistency and neutrality.
6.4 Visibility.
You acknowledge and agree that the Platform may make certain Community Content visible to Community members and, in some cases, to the general public, depending on Platform functionality and settings.
6.5 Moderation.
You may administer and manage Community Content within your Community spaces using the tools the Platform makes available. You acknowledge and agree that your ability to administer and manage Community Content is subject to Platform features, limitations, and enforcement.
6.6 Platform Role.
You acknowledge and agree that Pickleheart may organize, display, restrict, remove, or disable access to Community Content or Community features as needed to operate, protect, and maintain the Platform, including to address legal, policy, safety, integrity, or technical concerns.
7. Connectivity & Matching Tools
7.1 Tool Purpose.
You acknowledge and agree that the Platform may offer connectivity and matching tools intended to help users discover where, when, and with whom they may want to play.
7.2 Platform Layer.
You acknowledge and agree that connectivity, discovery, and matching tools operate at the Platform level (including in connection with Park entries), rather than as Community-controlled features.
7.3 No Community Operator Control.
You acknowledge and agree that Community Operators do not control, configure, enable, disable, or influence connectivity, discovery, or matching features, including any criteria, logic, or outputs of such features.
7.4 Advisory Nature.
You acknowledge and agree that connectivity, discovery, and matching outputs are informational and advisory only and do not guarantee outcomes, availability, compatibility, or participation by any user.
7.5 Player Choice.
You acknowledge and agree that users decide whether and how to connect with other users and whether to participate in any suggested interaction.
7.6 Privacy.
You acknowledge and agree that user visibility and any signals used by or displayed through connectivity and matching features are subject to each user’s privacy choices and Platform settings.
8. Chat & Communication Tools (Optional)
8.1 Feature Scope.
You acknowledge and agree that the Platform may provide chat and communication features that allow users to communicate within Communities and directly with other users on the Platform.
8.2 Community Chat Toggle.
You may choose to enable or disable chat spaces within your specific Community (“Community Chat”), subject to Platform functionality.
8.3 Community Chat Administration.
If Community Chat is enabled for your Community, you may administer and manage Community Chat spaces within that Community using the tools the Platform makes available, subject to these Terms and Platform enforcement.
8.4 No Community Chat.
If you disable Community Chat for your Community, you acknowledge and agree that there will be no Community Chat space within that Community and you will not have Community Chat administration tools for that Community.
8.5 Platform-Wide Chat.
You acknowledge and agree that disabling Community Chat for your Community does not disable chat for users on the Platform generally. Users may still communicate in other Communities where chat is enabled and may still communicate directly (including 1-to-1 messages) or in group chats outside your Community, subject to Platform functionality and enforcement.
8.6 Platform Enforcement.
You acknowledge and agree that all chat and communication activity on the Platform is subject to Platform enforcement, and Pickleheart may take action in response to violations, including restricting, removing, or disabling content, features, or accounts as needed to operate, protect, and maintain the Platform.
9. Store & Commerce (Optional)
9.1 Optional Feature.
You acknowledge and agree that Pickleheart may offer optional store and commerce features on the Platform (the “Store Features”).
9.2 Separate Store Operator Addendum Required.
You acknowledge and agree that use of any Store Features is governed solely by the Pickleheart Store Operator Addendum (the “Store Addendum”). The Store Addendum is separate from these Terms and must be affirmatively accepted (including via a separate checkbox or other explicit opt-in) before you may access or use Store Features.
9.3 No Store Features Unless You Opt In.
Unless and until you affirmatively accept the Store Addendum, you may not access or use Store Features, and no store-related revenue sharing, earnings, or payout terms apply to you.
9.4 Relationship to These Terms.
If you accept the Store Addendum, it is incorporated into and forms part of your agreement with Pickleheart for purposes of Store Features only. If there is any conflict between these Terms and the Store Addendum regarding Store Features, the Store Addendum controls.
9A. Earnings, Attribution & Revenue Sharing (Store Only)
9A.1 Governed by Store Addendum.
Any commissions, revenue sharing, earnings, attribution rules, payout mechanics, credits, or other store-related financial terms (collectively, “Store Earnings Terms”) are governed exclusively by the Store Addendum.
9A.2 No Store Earnings Terms Unless You Opt In.
Unless and until you affirmatively accept the Store Addendum, you have no rights to Store Earnings Terms and Pickleheart has no obligations to provide Store Earnings Terms to you.
9A.3 Reporting and Administration.
If you accept the Store Addendum, any reporting, calculations, and administration of Store Earnings Terms will be handled as described in the Store Addendum.
10. Content, Photos & Logos
10.1 Ownership.
As between you and Pickleheart, you retain ownership of the content you create, upload, submit, or otherwise make available through the Platform in connection with your Community (including photos, images, logos, artwork, text, and other materials) (“Operator Content”).
10.2 Platform License.
By providing Operator Content, you grant Pickleheart a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, publicly display, and otherwise exploit your Operator Content for any lawful purpose, including to operate, improve, market, promote, and expand the Platform and Pickleheart’s programs and mission. You acknowledge and agree that this license continues even if you stop being a Community Operator or stop using the Platform, to the extent Pickleheart continues to use the Operator Content.
10.3 Rights Clearance.
You represent and warrant that you have (and will maintain) all rights, permissions, licenses, consents, and authority necessary to provide Operator Content and to grant the license in Section 10.2, including all rights needed for Pickleheart to use the Operator Content as described in these Terms. You acknowledge and agree that you are solely responsible for ensuring that Operator Content does not infringe or misappropriate any third-party rights (including intellectual property, publicity, or privacy rights).
10.4 Takedowns.
Pickleheart may remove, restrict, disable access to, or refuse to host any Operator Content at any time, including in response to complaints, legal claims, policy concerns, or other integrity, safety, or operational reasons. Pickleheart may cooperate with legal authorities in connection with Operator Content as required by law or valid legal process, and has no obligation to provide information, reports, or materials to third parties absent such legal process.
11. Brand Use & Representation
11.1 Brand Ownership.
Pickleheart and its name, logos, trademarks, service marks, and other brand features are owned by Pickleheart or its licensors. Nothing in these Terms grants you any ownership interest in Pickleheart’s brand.
11.2 “On Pickleheart” Representation.
You may describe your Community as being “on Pickleheart” (or similar) so long as it is accurate and not misleading. You may not represent that you (or your Community) are Pickleheart, are officially endorsed by Pickleheart (unless Pickleheart has expressly stated otherwise), or have authority to act on Pickleheart’s behalf.
11.3 Revocation.
Pickleheart may restrict, modify, or revoke any permission it provides regarding how you reference Pickleheart’s brand, including if Pickleheart believes the use is misleading, confusing, or inconsistent with Platform integrity.
12. Conduct & Community Standards
12.1 Behavior-Based Enforcement.
You acknowledge and agree that Platform standards and enforcement are based on behavior and conduct on the Platform, including how you and members of your Community use Platform features and interact with others on the Platform. Pickleheart does not enforce Platform standards based solely on a person’s beliefs or viewpoints.
12.2 Prohibited Conduct.
You agree not to use the Platform (including your Community spaces) to engage in harassment, threats, discrimination, hate, or other disruptive conduct that undermines safety, trust, or the integrity of the Platform. You also agree to administer and manage your Community presence on the Platform in a manner consistent with these Terms and applicable Platform standards.
12.3 Enforcement.
Pickleheart may take action in response to violations of these Terms or Platform standards, including removing content, restricting features, suspending access, or taking other actions necessary to protect the Platform, its users, and Pickleheart’s mission.
13. Data, Privacy & Integrations
13.1 Player Control.
You acknowledge and agree that individual users control their own profiles, settings, and visibility options on the Platform to the extent such controls are provided by Pickleheart.
13.2 Admin Access.
You acknowledge and agree that your access to information about users is limited to what the Platform makes available to Community Operators in connection with administering and managing a Community on the Platform. You may not use any such information for purposes outside the Platform (including exporting, selling, or attempting to repurpose user data).
13.3 No Sale of Personal Data.
Pickleheart does not sell personal data as part of the Community Operator relationship described in these Terms. Pickleheart may use aggregated or de-identified information to operate, maintain, and improve the Platform.
13.4 Integrations.
The Platform may offer optional integrations with third-party services (for example, rating systems or other technology platforms). Any such integration is optional and may be subject to the third party’s terms and policies. Pickleheart does not control third-party services and is not responsible for third-party services or their terms.
14. Responsibility & Legal Protection
14.1 Platform Duties.
You acknowledge and agree that Pickleheart’s responsibility is to operate and maintain the Platform and its related technology services.
14.2 Community Operator Duties.
You acknowledge and agree that you are responsible for:
(a) your Operator Content (as defined in Section 10.1);
(b) how you administer and manage your Community’s presence on the Platform; and
(c) your compliance with these Terms and applicable Platform standards.
14.3 No Advice.
Pickleheart does not provide legal, tax, accounting, insurance, or other professional advice. You acknowledge and agree that you are responsible for obtaining any advice you may need in connection with your activities as a Community Operator.
14.4 Indemnification.
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Pickleheart and its directors, officers, employees, volunteers, and agents from and against any third-party claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) your Operator Content;
(b) your breach of these Terms; or
(c) your violation of applicable law in connection with your use of the Platform or administration of your Community.
15. Platform Changes & Admin Governance
15.1 Platform Updates and Changes.
You acknowledge and agree that Pickleheart may update, modify, suspend, or discontinue any part of the Platform (including features, tools, or functionality) at any time.
15.2 Community Lifecycle Actions.
You acknowledge and agree that Pickleheart may take actions affecting Communities and their presence on the Platform, including renaming, reorganizing, merging, restricting, or retiring Communities, as needed to operate and maintain the Platform.
15.3 Community Operator Administration and Continuity.
You acknowledge and agree that Pickleheart may add, remove, or replace Community Operators for a Community, or assign a Pickleheart administrator to a Community, including to support continuity, address inactivity, enforce Platform standards, or protect the integrity and operation of the Platform. Pickleheart may require any added or replacement Community Operator to accept the then-current Terms before receiving Community Operator privileges.
16. Leaving Pickleheart
16.1 Voluntary Exit.
You may stop acting as a Community Operator at any time by ceasing to use Community Operator features or by using any resignation/removal mechanism the Platform may provide.
16.2 No Ownership on Exit.
You acknowledge and agree that Communities are not owned by Community Operators and cannot be sold or transferred as property. Your decision to stop acting as a Community Operator does not create any obligation for Pickleheart to remove or transfer a Community.
16.3 Continuity After Exit.
You acknowledge and agree that if you stop acting as a Community Operator, Pickleheart may (as applicable) allow other Community Operators to continue administering the Community, assign a replacement Community Operator, assign a Pickleheart administrator, or retire the Community, consistent with Section 15.
16.4 Store Features.
If you have accepted the Store Addendum, your access to Store Features and any store-related participation will be governed by the Store Addendum, including any terms addressing suspension or termination of Store Features.
17. Legal Agreement Reference
17.1 Plain-Language Materials.
You acknowledge and agree that any plain-language explanations, FAQs, onboarding materials, or public-facing descriptions of Pickleheart are provided for convenience only and do not modify these Terms.
17.2 Store Addendum.
If you affirmatively accept the Store Addendum, it is incorporated into your agreement with Pickleheart for Store Features only, as described in Sections 9 and 9A.
17.3 Continued Use and Acceptance of Updates.
You acknowledge and agree that your continued use of Community Operator features after Pickleheart updates these Terms constitutes acceptance of the updated Terms.
18. Dispute Resolution; Arbitration; Governing Law; Severability; Miscellaneous.
18.1 Disputes Covered.
“Dispute” means any dispute, claim, or controversy between you and Pickleheart arising out of or relating to these Terms, the Platform, your role as a Community Operator, your Community, or Operator Content, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.
18.2 Agreement to Binding Arbitration (No Court Litigation).
Except as expressly permitted in Section 18.6 (Small Claims) and Section 18.7 (Injunctive or Equitable Relief), you and Pickleheart agree that all Disputes will be resolved by final and binding arbitration, and not in court.
18.3 Arbitration Provider and Rules (New Era ADR).
The arbitration will be administered by New Era ADR, Inc. (“New Era ADR”) and conducted under New Era ADR’s applicable rules and procedures in effect at the time the arbitration is initiated (the “Rules”). Information about New Era ADR and its Rules is available on New Era ADR’s website.
18.4 Virtual Proceedings.
Unless the parties agree otherwise or the arbitrator determines otherwise under the Rules, the arbitration will be conducted virtually using New Era ADR’s arbitration platform or other virtual means permitted by the Rules.
18.5 Individual Basis.
You and Pickleheart agree that arbitration will be conducted only on an individual basis, and not on a class, collective, representative, or private-attorney-general basis.
18.6 Small Claims (Limited Exception).
Either party may bring an individual claim in small claims court if (a) the claim qualifies to be brought in small claims court, and (b) the claim is brought and remains on an individual, non-representative basis.
18.7 Injunctive or Equitable Relief (Limited Exception).
Either party may seek temporary injunctive or other equitable relief in a court of competent jurisdiction to preserve the status quo or prevent irreparable harm pending resolution of the Dispute in arbitration.
18.8 Governing Law.
These Terms and any Dispute will be governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, except that the Federal Arbitration Act will govern the interpretation and enforcement of Sections 18.2 through 18.7 to the fullest extent applicable.
18.9 Severability.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
18.10 Assignment.
Pickleheart may assign these Terms, in whole or in part, including in connection with a reorganization, merger, acquisition, or transfer of assets. You may not assign these Terms without Pickleheart’s prior written consent.
18.11 Entire Agreement.
These Terms (together with any addenda you affirmatively accept, including the Store Addendum if applicable) constitute the entire agreement between you and Pickleheart regarding your role as a Community Operator and supersede any prior or contemporaneous agreements or understandings on that subject.
18.12 No Waiver; Headings; Survival.
Pickleheart’s failure to enforce any provision is not a waiver of its right to enforce it later. Headings are for convenience only. Sections that by their nature should survive termination (including Sections 10, 14, 18, and the Store Addendum if accepted) will survive.
